Fortunately, there is a strategy called Safe Harbor that allows businesses to lock in current incentives while giving projects time to move through planning and construction.

Here’s what you need to know about protecting your 40-65% tax incentives, and why starting now is the smartest path forward.

What is Safe Harbor?

“Safe harbor” is a legal tax mechanism that allows your business to freeze today’s favorable tax rules and lock them in for the future. This essentially pauses the federal clock.

Commercial solar projects are not overnight purchases. They require careful engineering, permitting, utility coordination, and site planning. Safe Harbor exists so organizations do not have to rush these critical steps simply to secure savings.

The Two Safe Harbor Paths

There are two primary ways organizations can preserve their federal tax credit eligibility. No matter what approach you take, we will help you choose a system that is properly designed, fully optimized, and aligned with your long-term operational goals.

Option 1: Small Deposit, Extended Timeline

One option allows businesses to secure Safe Harbor status with a 5% upfront investment, but must be paid by July 4th, 2026. This route provides a longer project completion window to 2030 and may work well for organizations already in the planning stage or looking a few years ahead. 

While this upfront commitment is smaller, the process still requires significant preparation behind the scenes; commercial projects involve months (average 6 months) of work before construction begins. This deadline is right around the corner, so we are here to walk you through this approach!

Option 2: Our Recommended Approach

At Sugar Hollow Solar, we strongly encourage organizations to begin the Safe Harbor process sooner rather than later and work toward completing their project(s) on a practical timeline by December, 31st 2027.

Why 2027? Because this is the second and more secure Safe Harbor route. Although the project completion time is sooner, putting a deposit down by July 4th might not be the easiest path for your business. Starting the process now and targeting completion by the end of 2027 gives your organization more time to build the project out instead of rushing to meet the immediate deadline. This route works well for organizations who know they want solar, but may be uncertain about project costs or unable to make the initial 5% investment right away.
